This NETLAB+ Internet Setup and Use Agreement For RING labs
(this "Agreement") is made effective as of
(the "Effective Date"), by and between
__________, with an address at
__________
("Customer"), and Network Development Group, Inc. ("NDG"). Capitalized
terms used herein and not otherwise defined shall have the meanings given
to such terms in the Customer Agreement (as defined below).
-
Customer has installed or is planning to install a lab environment in connection with
NDG's NETLAB+ product to support training associated with the RING labs.
Customer has decided to add optional functionality to allow trainees (including
without limitation remote trainees) to access and use the Internet through the lab
environment. Reference topology at the bottom of this diagram showing further details of the
RING CE lab training environment.
-
Customer acknowledges and agrees that Customer is solely responsible for
configuring and managing the firewalls and associated software, including without
limitation all security features and policies associated with the pod and customer
firewalls.
-
Customer specifically agrees to log all Internet usage by users (trainees) made
through the lab environment, following logging instructions, subject to Customer's
compliance with all applicable laws. Note that, because of the nature of lab setup as
shown in RING TOPOLOGY, Customer will not be able to track Internet usage by
MAC address, so it is vital that Customer set up logging appropriately.
-
This Agreement is made part of and is subject to the NETLAB+ Customer Agreement, which is maintained at
http://www.netdevgroup.com/support/netlab_customer_agreement.html
(the "Customer Agreement"). Any conflict
between any term or provision in the Customer Agreement and a term or provision in this Agreement shall be
resolved in favor of this Agreement. The parties hereby confirm their agreement to the terms of the
Customer Agreement.
-
Customer agrees that Customer is fully responsible for, and that NDG will have no liability or responsibility
for: (a) any Internet use by any users of the RING lab training environment or any additional lab environments
that Customer sets up using Internet access requiring firewalls, and (b) monitoring, securing and logging
Internet activity occurring through the lab training environment.
-
This Agreement may be executed in counterparts with the same effect as if the parties had signed the same document
(that is, the parties do not need to actually sign the same piece of paper for this Agreement to be effective).
All fully executed counterparts shall be construed together and shall constitute one and the same agreement.
